1. SPONSOR: The Powder Valley Sweepstakes (the “Sweepstakes”) is sponsored by Powder Valley (“Sponsor”). This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with any third parties, including social media platforms.
2. ELIGIBILITY: The Sweepstakes is open to legal residents of United States, aged 18 or older, at the time of entry. Employees of Powder Valley, its affiliates, subsidiaries, advertising and promotion agencies, Dealer accounts and their immediate family members and/or those living in the same household of each are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.
3. ENTRY PERIOD: The Sweepstakes begins on 12/4/24 and ends on 12/15/24 (the “Entry Period”). Entries that are submitted before or after the Entry Period will be disqualified.
4. HOW TO ENTER: Entrants can enter the Sweepstakes by filling out an online form. Limit one entry per person per day. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, or any other methods may void that entrant’s entries, and that entrant may be disqualified.
5. PRIZE: The 12 prizes vary by day and by value. Each day’s prize will be posted on Facebook and Instagram. The prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion.
6. WINNER SELECTION: A random drawing will be conducted the following day by Sponsor or its designated representatives. The odds of winning depend on the number of eligible entries received. The winner will be notified by email or phone on the next business day. If a potential winner cannot be contacted, is ineligible, or fails to claim the prize within 3 days from the time award notification was sent, the prize may be forfeited, and an alternate winner selected.
7. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner.
8. PUBLICITY: Acceptance of the prize constitutes permission for Sponsor to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.
9. LIMITATION OF LIABILITY: By entering, participants agree to release and hold harmless Powder Valley and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such participant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service, (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes, (v) electronic or human error in the administration of the Sweepstakes or the processing of entries.
10. DISPUTES: This Sweepstakes is governed by the laws of Kansas, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participants agree that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Kansas having jurisdiction.

12. WINNER’S RESPONSIBILITY/TAXES: The winner is solely responsible for any and all federal, state, and local taxes and fees associated with the receipt and use of the prize. Sponsor will not be held liable for any such taxes or fees, should they apply.
